Paternity is a legal determination of parentage that must be established before the family law court can issue a child support order or visitation rights. Under California law, a rebuttable presumption of paternity exists if a child is born to a marital couple or within 300 days of the termination of a marriage by death, divorce or annulment. 
With respect to unwed couples, even if a Voluntary Declaration of Paternity was executed upon the birth of a child, parentage must still be formally established before court prior to the determination of custody, issuance of a support order, or granting of visitation rights. It should be noted that a Voluntary Declaration of Paternity may be rescinded within 60 days.

When parentage is disputed, the court then has the authority to order DNA testing after a paternity action has been filed. Based on these results, the judge will either enter an order of parentage or dismiss the suit.
